Welcome to Cross Exchange! These Terms and Conditions (“Terms”) form a legally binding agreement between you and Cross Exchange International Ministries, Inc. (referred to as “Cross Exchange”, “we,” “us,” “our,” or “Platform”) governing your access to and use of our website, mobile applications, and services (collectively the “Platform”). By using the Platform, you agree to comply with these Terms and Conditions. If you do not agree with any part of these Terms, you must discontinue using our Platform immediately.
Please read these Terms carefully as they contain important information about your legal rights, remedies, and obligations.
Cross Exchange is a Christian work exchange platform that connects volunteers (“Travelers” or “Members”) and hosts (“Hosts”). Our purpose is to facilitate opportunities for cultural exchange and service, where volunteers assist Hosts in exchange for accommodation and other agreed-upon benefits. The arrangement between Travelers and Hosts is based on mutual agreement and is not considered an employment or labor relationship.
1.2 Cross Exchange’s Role
Cross Exchange does not own, manage, or control any of the properties or services offered by Hosts, nor does it organize travel or provide employment services. We are not responsible for the actions or omissions of any Traveler or Host, and we do not become a party to any agreements made between Travelers and Hosts. Cross Exchange is not an agency, and we do not act as an employer, travel agent, or insurer.
You must be at least 18 years old to register as a Traveler or Host on Cross Exchange. By using the Platform, you represent and warrant that you are at least 18 years old and have the legal capacity to enter into binding agreements.
3. Registration & Account Responsibilities
To use certain features of the Platform, you must register and create an account. You agree to provide accurate, current, and complete information during the registration process. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur through your account.
You are responsible for safeguarding your login credentials and must notify Cross Exchange immediately if you suspect any unauthorized use of your account. We are not liable for any loss or damage arising from your failure to secure your account.
3.3 Identity Verification
Hosts are required to complete a video call with Cross Exchange staff as part of our host verification process. This is an additional safety measure to ensure the legitimacy of the Hosts and their properties. Travelers may also be asked to verify their identity through Jumio, a third-party identity verification service. Cross Exchange reserves the right to remove or suspend accounts that fail to complete identity verification or that provide false information.
4. Host and Traveler Responsibilities
- Hosts are responsible for providing accurate and complete information about their properties, including the types of work, accommodations, and any benefits offered.
- Hosts must maintain updated listings and respond promptly to inquiries from Travelers.
- Hosts agree not to ask Travelers to perform work beyond what is reasonably expected in a volunteer exchange. Asking for dangerous, illegal, or otherwise inappropriate work is strictly prohibited.
- Travelers are expected to communicate with Hosts in good faith and honor any commitments made once accepted into a work exchange.
- Travelers must leave the property in the same condition they found it and abide by any house rules set by the Host.
- Travelers agree to take responsibility for their own visas, travel arrangements, and compliance with local laws.
2.2 Compliance with Local Laws
Hosts and Travelers are solely responsible for ensuring that their use of Cross Exchange complies with all applicable local laws, including those related to visas, work permits, taxes, insurance, and safety standards.
Hosts are not charged for registering or listing opportunities on the Platform. However, in cases where extra features are offered (such as priority listings or promotions), Hosts may be required to pay for these optional services.
While we take precautions to verify Hosts and offer resources for safe exchanges, Cross Exchange does not guarantee the safety or conduct of any Host or Traveler. You are responsible for exercising caution and making your own assessments regarding personal safety, the suitability of the work environment, and the legitimacy of any opportunities.
6. Safety and Dispute Resolution
In the event of a dispute between a Host and Traveler, we encourage both parties to resolve their issues directly. Cross Exchange may, at its discretion, offer assistance in facilitating communication, but we are not responsible for mediating disputes or enforcing any agreements.
In cases where a Host fails to honor their commitments (e.g., not providing agreed-upon accommodation), Cross Exchange may assist the Traveler by suggesting alternative Hosts in the area. Cross Exchange is not liable for any travel costs, accommodations, or other expenses incurred by Travelers in such cases.
Travelers may cancel an accepted work exchange by notifying the Host as soon as possible. Repeated cancellations without valid reasons may result in account suspension or termination.
7.1 Traveler Cancellations
If a Host cancels a confirmed arrangement, the cancellation will be noted on the Host’s profile. Repeated or last-minute cancellations may result in penalties, including removal from the platform.
8. Content and Intellectual Property
8.1 User-Generated Content
By submitting content (such as reviews, photos, or descriptions) to Cross Exchange, you grant us a worldwide, non-exclusive, royalty-free, transferable license to use, distribute, and display that content on the Platform. You retain ownership of your content, but Cross Exchange has the right to use it for promotional purposes.
All intellectual property on the Platform, including text, graphics, logos, and software, is the exclusive property of Cross Exchange or its licensors. You may not copy, modify, distribute, or reproduce any part of the Platform without our written consent.
9. Limitation of Liability
9.1 No Liability for Host and Traveler Interactions
Cross Exchange is a platform for connecting Travelers and Hosts, but we do not guarantee the quality, safety, or legality of any opportunities. We are not liable for any interactions, agreements, or disputes between Hosts and Travelers.
9.2 Platform Use at Your Own Risk
Your use of the Platform is at your own risk. Cross Exchange disclaims all liability for any direct, indirect, incidental, or consequential damages arising from your use of the Platform, including but not limited to loss of profits, property damage, or personal injury.
The Platform and its services are provided on an “as is” and “as available” basis without any warranties, express or implied. We do not warrant that the Platform will be free of errors, interruptions, or security breaches.
You agree to indemnify and hold harmless Cross Exchange, its directors, employees, and affiliates from any claims, damages, losses, or expenses, including legal fees, arising from your use of the Platform, your violation of these Terms, or your interactions with other users.
10. Privacy and Data Protection
Your privacy is important to us. Please refer to our Privacy Policy for detailed information on how we collect, use, and protect your personal information.
11. Modifications and Termination
Cross Exchange reserves the right to modify these Terms at any time. We will notify users of any changes by updating the “Last Updated” date at the top of these Terms. Continued use of the Platform after changes are made constitutes acceptance of the revised Terms.
Cross Exchange reserves the right to terminate or suspend your account at any time if you violate these Terms or engage in behavior that we deem harmful to the community. Upon termination, you will lose access to your account, and any rights you had to use the Platform will immediately cease.
12. Governing Law and Jurisdiction
These Terms and any disputes arising from your use of the Platform will be governed by and construed in accordance with the laws of the state of Delaware (the state in which Cross Exchange is incorporated), without regard to its conflict of law provisions. Any legal actions or proceedings related to your use of the Platform must be brought in the appropriate courts of that state.
These Terms, along with our Privacy Policy and any other policies referenced herein, constitute the entire agreement between you and Cross Exchange and supersede any prior agreements or understandings.
If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary so that these Terms will otherwise remain in full force and effect.
The failure of Cross Exchange to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision. Any waiver of any provision of these Terms will be effective only if in writing and signed by an authorized representative of Cross Exchange.
